1. Acceptance of Terms

By accessing or using FundedKit (“the Service”), operated by Avantware Ltd (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

FundedKit is a web-based platform that helps traders manage prop firm accounts, journal trades, track drawdown limits, analyse performance, and compare prop trading firms. The Service includes free and paid subscription tiers.

3. Account Registration

• You must be at least 18 years old to use the Service.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete information when creating an account.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account.

4. Subscriptions & Payments

• FundedKit offers Free and Pro subscription tiers.
• Paid subscriptions are billed monthly or annually via Stripe.
• Prices are in USD and may be subject to applicable taxes.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods, except as required by law.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to the Service or its systems.
• Interfere with or disrupt the Service or servers.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Share your account credentials or allow others to access your account.
• Use automated systems (bots, scrapers) to access the Service without permission.
• Upload malicious content, viruses, or harmful files.

6. Your Data

• You retain ownership of all trading data, journal entries, screenshots, and other content you create in the Service.
• You grant us a limited licence to store, process, and display your data solely to provide the Service.
• You may export or delete your data at any time.
• Our handling of your data is governed by our Privacy Policy.

7. Trading Platform Connections

• When you connect a trading platform (MT5, cTrader, Tradovate), you authorise us to access your account data via their APIs.
• We access data in read-only mode where possible. We do not execute trades on your behalf unless you explicitly enable copy trading features.
• You are responsible for ensuring your platform credentials are valid and that you have the right to connect your accounts.
• We are not liable for any issues arising from third-party platform connections.

8. AI Features

The Service includes AI-powered features (AI Coach) that analyse your trading data and provide suggestions. These features are for informational purposes only and do not constitute financial advice. You should not rely solely on AI suggestions for trading decisions.

9. Disclaimer

FundedKit is not a financial advisor, broker, or trading platform. The Service provides tools for tracking and analysing your trading activity. We do not provide investment advice, trading signals, or recommendations.

Trading in financial markets involves substantial risk of loss. Past performance is not indicative of future results. You are solely responsible for your trading decisions.

The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Avantware Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or trading losses, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Prop Firm Affiliation

FundedKit is an independent product and is not affiliated with, endorsed by, or sponsored by any proprietary trading firm. Firm data, rules, and logos displayed in the Service are provided for informational purposes and may not reflect the most current terms of each firm.

12. Termination

• You may close your account at any time by contacting support.
• We may suspend or terminate your account if you violate these terms.
• Upon termination, your right to use the Service ceases. We may retain certain data as required by law.

13. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use after changes constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the United Kingdom. Any disputes shall be resolved in the courts of the United Kingdom.
